These Terms & Conditions of Sale (“Terms”) explain the terms on which Aesthetic Technology Ltd, trading as Dermalux (“Dermalux”, “we”, “us” or “our”), supplies products purchased through dermalux.com.

Please read these Terms carefully before placing an order. By placing an order through our website, you agree to be bound by these Terms.

These Terms apply in addition to our Privacy Policy and Shipping, Returns & Warranty Policy.

Nothing in these Terms affects your statutory rights as a consumer.

ABOUT THESE TERMS

These Terms apply to purchases made by consumers through dermalux.com.

 Please read them carefully before placing an order. We recommend that you save or print a copy for your records.

We may update these Terms from time to time. The Terms that apply to your purchase will be those in force at the time you place your order.

If you are purchasing Dermalux products on behalf of a business or for professional or commercial use, separate terms may apply.

 

WHO CAN PLACE AN ORDER

To place an order through our website, you must:

  • be at least 18 years old;
  • be legally capable of entering into a binding contract; and
  • provide accurate and complete information when placing your order.

You are responsible for ensuring that the information you provide to us is correct and up to date.

 

OUR PRODUCTS

We take reasonable care to ensure that product descriptions, specifications, images and other information displayed on our website are accurate.

However, images are for illustrative purposes and colours, finishes, packaging or other minor details may vary slightly from those displayed, including as a result of screen settings or product improvements.

Product packaging and presentation may also change from time to time without affecting the product's intended function or performance.

All products are subject to availability.

We reserve the right to make changes to product specifications where necessary to comply with applicable legal or regulatory requirements or where those changes do not materially affect the product's function or performance.

 

PLACING YOUR ORDER

When you place an order through dermalux.com, you are making an offer to purchase the products in your order subject to these Terms.

Before submitting your order, you will have the opportunity to review your order and correct any errors.

Once your order has been submitted, we will send you an email acknowledging that we have received it.

This acknowledgement does not mean that your order has been accepted.

 

ORDER ACCEPTANCE

Your order is accepted and a contract between you and Dermalux is formed when we send you confirmation that your order has been dispatched.

We reserve the right not to accept an order. This may happen, for example, if:

  • a product is unavailable;
  • we are unable to authorise your payment;
  • we identify an error in the price or product description;
  • we are unable to deliver to your location;
  • your order exceeds applicable purchase limits; or
  • we reasonably suspect fraudulent or unauthorised activity.

If we cannot accept your order after payment has been taken, we will refund the amount paid.

 

PRICES AND PAYMENT

All prices displayed on dermalux.com are shown in the applicable currency and include VAT or other applicable sales taxes where stated.

Delivery charges, where applicable, will be shown before you complete your order.

We take reasonable care to ensure that prices displayed on our website are correct. However, errors may occasionally occur.

If we discover an obvious pricing error before accepting your order, we will contact you and give you the option to proceed at the correct price or cancel your order.

We accept the payment methods displayed at checkout.

Payment must be authorised before your order can be processed.

Where you choose to pay using a third-party payment or instalment provider, additional terms from that provider may apply. Dermalux is not responsible for the terms of any separate agreement between you and the payment provider.

 

PROMOTIONAL CODES AND OFFERS

From time to time, Dermalux may offer promotional codes, launch offers, welcome offers or other promotions.

Unless otherwise stated:

  • promotional codes are limited to one use per customer;
  • only one promotional code may be used per order;
  • promotional codes cannot be exchanged for cash;
  • promotional codes cannot be used in conjunction with another offer; and
  • promotional codes must be entered at checkout before the order is completed.

Individual promotions may have additional conditions, including qualifying products, minimum spend, eligibility requirements and expiry dates. These will be communicated with the relevant promotion.

We reserve the right to refuse, withdraw or cancel a promotional code where we reasonably believe it has been used fraudulently, incorrectly or in breach of the applicable promotion terms.

If a product purchased using a promotional code is returned, any refund will reflect the amount actually paid for the product.

 

PRODUCT AVAILABILITY

All orders are subject to product availability.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.

Where we cannot fulfil your order, we will cancel the affected item and refund any amount you have paid for it.

Where products are available for pre-order, the estimated availability or dispatch date will be shown on the relevant product page or communicated to you separately.

Any pre-order date is an estimate and may be subject to change. If there is a significant delay, we will let you know.

 

DELIVERY

We deliver to the countries and territories shown at checkout.

Available delivery methods, estimated delivery times and any applicable charges will be displayed during checkout.

Our current delivery information is available in our Shipping, Returns & Warranty Policy.

Delivery times are estimates unless we expressly agree a specific delivery date with you.

We will take reasonable steps to deliver your order within the estimated timeframe.

However, delays may occasionally occur due to circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the delivery information you provided is incorrect or incomplete, additional delivery charges may apply where we need to resend the order.

For EU orders where Dermalux states that duties and import taxes are prepaid or included, you should not be required to pay additional duties on delivery. This should remain aligned with your actual checkout and fulfilment arrangements.

UK distance-selling guidance states that goods should normally be delivered within 30 days unless another timeframe has been agreed with the customer. 

 

RISK AND OWNERSHIP

A product becomes your responsibility when it is delivered to you or to a person identified by you to receive it.

Ownership of the product passes to you once we have received payment in full.

 

CANCELLATIONS, RETURNS & REFUNDS

YOUR STATUTORY RIGHT TO CANCEL

If you are a UK consumer purchasing online, you generally have a legal right to change your mind and cancel your contract without giving a reason.

For most goods, the cancellation period ends 14 days after the day on which you receive the goods. Government guidance confirms that after notifying the retailer within this period, consumers generally have a further 14 days to return the goods. 

To exercise your statutory right to cancel, you must clearly inform us of your decision to cancel within the applicable cancellation period.

You can do this by contacting us at hello@dermalux.com or through our online returns process.

You may also use the model cancellation form provided at the end of these Terms, although you are not required to use it.

Certain exclusions to the statutory right to cancel may apply. In particular, statutory cancellation rights may be lost for sealed goods that are not suitable for return for health protection or hygiene reasons once they have been unsealed, where the legal requirements for that exception are met. Government guidance expressly recognises an exception for sealed health/hygiene goods once opened. 

 

DERMALUX 30-DAY RETURNS POLICY

In addition to your statutory rights, Dermalux offers a 30-day returns policy.

If you change your mind, you must notify us and return your order within 30 days of receiving it to be eligible for a refund under this additional policy.

For hygiene reasons, Dermalux devices returned under our 30-day returns policy must be unused and returned with all original accessories and packaging intact, unless the device is faulty.

To begin a return, please use our online returns portal or contact us at hello@dermalux.com.

Returns of the Dermalux LED Face Mask are free under our current returns policy.

For Dermalux Flex MD returns, return postage is the customer's responsibility and is non-refundable, unless the product is faulty or we have agreed otherwise. If arranging your own return, please package the product securely and retain proof of postage.

Our 30-Day Returns Policy is in addition to, and does not affect, your statutory rights.

 

REFUNDS

Once your return has been received and inspected, we will process any refund due to your original payment method.

Under our commercial 30-day returns policy, we aim to process refunds within 5 working days after the returned product has been received and inspected.

Please allow additional time for your bank or payment provider to credit the refund to your account.

Where you exercise your statutory cancellation rights, we will provide any refund due within the timescales required by applicable law. UK guidance currently requires the retailer to refund a consumer within 14 days of receiving the returned goods and, where applicable, to refund the cost of standard delivery. 

If you selected a more expensive delivery method than our standard delivery option, we are not required to refund the additional delivery cost above the standard delivery charge where the law permits.

 

FAULTY, DAMAGED OR INCORRECT PRODUCTS

We take great care in the manufacture and fulfilment of Dermalux products.

If your product arrives damaged, is faulty, is not as described or you receive an incorrect product, please contact us at hello@dermalux.com as soon as reasonably possible.

Where appropriate, we may ask you to provide photographs or other information to help us assess the issue.

We will review the matter and provide an appropriate remedy in accordance with your legal rights.

Nothing in these Terms limits your statutory rights in relation to faulty, damaged or misdescribed goods.

UK consumer law requires sellers to provide remedies where goods are faulty, not as described or do not do what they are supposed to do. Those rights cannot lawfully be removed through standard sales terms. 

 

DERMALUX WARRANTY

2-YEAR DERMALUX WARRANTY

Every eligible Dermalux device is covered by a 2-year manufacturer's warranty against manufacturing defects, subject to the applicable warranty terms.

Rechargeable batteries are covered for 1 year.

Where required under our warranty terms, you should register your Dermalux device after purchase to activate your manufacturer's warranty.

Proof of purchase may be required when making a warranty claim.

The warranty applies to the original purchaser and does not cover, for example:

  • accidental damage;
  • misuse or use contrary to the User Guide;
  • normal wear and tear;
  • unauthorised repairs or modifications;
  • damage caused by incompatible or non-approved accessories or charging equipment; or
  • products where the serial number or product identification has been removed or altered.

If you experience an issue with your Dermalux device, contact hello@dermalux.com and our team will advise you on the next steps.

The Dermalux manufacturer's warranty is in addition to, and does not affect, your statutory consumer rights.

 

USING DERMALUX PRODUCTS

PRODUCT USE AND SAFETY

Dermalux devices should only be used in accordance with the User Guide, instructions, safety information and contraindications supplied with the device.

Please read the User Guide and relevant safety information before using your Dermalux device for the first time.

Certain medical conditions, medications or circumstances may make LED Phototherapy unsuitable for some individuals.

If you are taking medication, have a medical condition or are unsure whether a Dermalux device is suitable for you, please seek appropriate medical advice before use.

Do not use a Dermalux device contrary to the contraindications or safety instructions provided.

Nothing in this section excludes or limits Dermalux's responsibility for a defective product or any other liability that cannot legally be excluded or limited.

 

PROFESSIONAL OR MEDICAL ADVICE

Information provided on dermalux.com is intended to provide general information about Dermalux products and LED Phototherapy.

It is not intended to replace individual medical advice, diagnosis or treatment.

If you have a medical condition, are taking medication or have concerns about whether a Dermalux product is appropriate for you, please consult an appropriately qualified healthcare professional.

 

OUR RESPONSIBILITY TO YOU

OUR LIABILITY

We are responsible to you for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable.

Dermalux products purchased through our consumer website are supplied for private use. If you use a product for commercial, business or resale purposes, we will not be responsible under these consumer Terms for business losses such as loss of profit, revenue, business or business opportunity, except where applicable law provides otherwise.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot lawfully be excluded; or
  • breach of your statutory consumer rights.

Consumer contract terms must be fair, and businesses cannot simply disclaim responsibilities that the law places on them. 


EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failures to perform our obligations where these result from events outside our reasonable control.

This may include, for example, severe weather, transport disruption, industrial action, interruption to utilities or communications networks, government action, natural disasters or disruption affecting suppliers or delivery providers.

If an event outside our control significantly affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the impact.

Your statutory rights remain unaffected.

 

WEBSITE & DATA

INTELLECTUAL PROPERTY

All intellectual property rights in the Dermalux website and its content, including the Dermalux name, trademarks, logos, product names, designs, photographs, graphics, text and other materials, are owned by or licensed to Aesthetic Technology Ltd unless otherwise stated.

You may access and use our website for your personal, non-commercial use.

You must not reproduce, distribute, modify, commercially exploit or otherwise use our website content without our prior written permission, except where permitted by law.

 
PRIVACY AND COOKIES

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy, and where available you can manage your choices through Cookie Preferences.

These policies form part of the information available to you when using dermalux.com but do not alter your statutory consumer rights.

 

GENERAL

TRANSFERRING THESE TERMS

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a reorganisation or transfer of our business.

If this happens and the transfer could materially affect your rights, we will notify you where required.

You may only transfer your rights or obligations under these Terms to another person where we agree in writing or where applicable law allows you to do so.

 

IF PART OF THESE TERMS IS INVALID

Each section of these Terms operates separately.

If a court or relevant authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue to apply.


DELAY IN ENFORCING THESE TERMS

If we do not immediately insist that you comply with an obligation under these Terms, or if we delay taking action in respect of a breach, this does not mean that we have waived our rights.

 
THIRD-PARTY RIGHTS

Unless expressly stated otherwise, these Terms are between you and Dermalux.

No other person has the right to enforce them.

 
CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, products, website or applicable legal or regulatory requirements.

Any changes will apply to orders placed after the updated Terms are published.

The Terms applicable to an existing order will generally be those in force when that order was placed.

 

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring legal proceedings in Scotland or England and Wales.

If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or England and Wales.

If you live elsewhere, you may also have rights under the mandatory consumer laws of the country in which you live.
